Overlook Records (“Overlook,” “we,” “our,” or “us”) welcomes music submissions from independent artists.
By submitting music, recordings, links, written materials, or any other content (collectively, the “Submission”) through this website or through any electronic means associated with Overlook Records, you acknowledge and agree to the following Terms of Submission.
Voluntary Submission
All materials submitted to Overlook Records are provided voluntarily and at the sole initiative of the submitting party.
Submission of any material does not create any contractual, fiduciary, agency, partnership, joint venture, employment, management, or other business relationship between the submitting party and Overlook Records.
Submission of materials does not constitute an offer, promise, guarantee, or expectation of review, feedback, collaboration, representation, promotion, distribution, or any other professional relationship.
No Obligation to Review or Respond
Overlook Records receives a high volume of submissions and does not guarantee that any Submission will be reviewed.
Overlook Records is under no obligation to:
• review submitted materials
• respond to submissions
• provide feedback or evaluation
• retain submitted materials
• return submitted materials
• enter into any agreement with the submitting party
Any future collaboration or agreement with Overlook Records must be established through a separate written agreement signed by authorized representatives of both parties.
Ownership and Authority
By submitting materials to Overlook Records, you represent and warrant that:
• you are the owner of the submitted material or have full legal authority to submit it
• the material does not infringe upon the copyrights, trademarks, or other rights of any third party
• the submission does not violate any contractual agreements with other labels, publishers, managers, distributors, or partners
You agree to indemnify and hold harmless Overlook Records from any claims, liabilities, damages, or expenses arising from a breach of these representations.
No Expectation of Confidentiality
Submissions made through the Overlook Records website are not confidential.
Overlook Records does not accept or agree to hold submissions in confidence and assumes no obligation to maintain the confidentiality of any submitted materials.
Submitting parties should not submit materials that they consider confidential or proprietary.
Independent Development and Similarity
You acknowledge that Overlook Records may currently be developing, producing, promoting, or working with artists, recordings, or creative materials that may be similar to the materials you submit.
You agree that the existence of similarities between your submission and other works developed independently by Overlook Records, its affiliates, artists, partners, or collaborators shall not constitute grounds for any claim or legal action against Overlook Records.
Limitation of Liability
To the fullest extent permitted by applicable law, Overlook Records shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to:
• submission of materials
• use of this website
• review or non-review of submitted materials
• similarities between submitted materials and other works
Use of this website and submission of materials is done at your own discretion and risk.
Governing Law
These Terms of Submission shall be governed by and interpreted in accordance with the laws of the State of Tennessee, United States, without regard to conflict-of-law principles.
Any disputes arising in connection with these terms shall be subject to the jurisdiction of the appropriate courts located in Tennessee.
Modification of Terms
Overlook Records reserves the right to update or modify these Terms of Submission at any time. Updates will be posted on this page with a revised “Last Updated” date.
Continued use of the website following any updates constitutes acceptance of the revised terms.
